This Privacy Policy explains what information Whale Limit collects when you use our website and app (the "Service"), how we use it, and the choices you have. By using the Service you agree to this policy.

Information we collect

• Account information — the email address you sign in with, your username, and your first and last name. Your real name is shown to a pool only if that pool's commissioner turns on real-name viewing; otherwise only your username is shown.
• Pool activity — the pools you join or run, the picks and tiebreaker guesses you make, your results, and messages you post on a pool's board.
• Payment information — none. Whale Limit is free to use, so we do not collect or process any payment or card information.
• Technical information — basic device and browser information, and data we keep in your browser's local storage (such as your sign-in token and interface preferences) to keep you signed in and remember your settings.

How we use your information

• To operate the Service — signing you in, running your pools, grading picks, and showing standings.
• To send transactional email — sign-in codes, pick confirmations, and the pool notifications a commissioner has enabled (for example, "the slate is live" or "locks in one hour").
• To keep the Service secure, prevent abuse, and fix problems.

How your information is shared

We do not sell your personal information. We share it only as needed to run the Service:

• Within your pool — your username, picks (per the commissioner's reveal settings), and results are visible to other members of pools you join. Your real name is shared only if the commissioner enables real-name viewing.
• Service providers — email delivery (Resend) and hosting. These providers process data on our behalf and only for the Service.
• Legal reasons — if required by law, or to protect the rights, safety, or property of Whale Limit or others.

Email and notifications

Sign-in codes and receipts are essential to the Service and are always sent. Other pool notifications are controlled by each pool's commissioner and by the pool's settings.

Cookies and local storage

We use your browser's local storage to keep you signed in and to remember preferences (such as your time zone and dismissed announcements). We do not use third-party advertising or cross-site tracking.

Data retention and security

We keep your information for as long as your account is active or as needed to provide the Service and meet legal obligations. We use reasonable technical and organizational measures to protect it, though no method of transmission or storage is completely secure.

Your choices

• Update your username, name, email, or time zone anytime on your profile.
• Ask us to close your account and delete your personal information by emailing support@whalelimit.com.

Children

The Service is intended for adults and is not directed to anyone under 18. We do not knowingly collect information from children.

Changes

We may update this policy from time to time. Material changes will be reflected by the "last updated" date above.

Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Whale Limit governing your use of our website and app (the "Service"). By accessing or using the Service, or by continuing past the sign-in screen, you agree to these Terms. If you do not agree, do not use the Service.

What Whale Limit is — and is not

Whale Limit is software that helps a commissioner run a pool: setting rules, publishing slates with frozen lines, collecting picks, and grading results. Whale Limit is not a sportsbook or gambling operator. We do not accept wagers, and we do not collect, hold, escrow, or pay out any pool's entry fees, prize pot, or winnings. Any money among pool members is entirely between those members.

Eligibility and your responsibilities

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for complying with all laws that apply to you, including any laws in your location about contests, pools, or wagering. You use the Service at your own discretion and risk.
• You are responsible for the accuracy of the information in your account and for activity that happens under it. Keep access to your sign-in email secure.

Commissioner responsibilities

If you run a pool, you set its rules and are responsible for how it operates, including any handling of money among your members. You agree not to use the Service to run anything unlawful.

Acceptable use

You agree not to: break any law; interfere with or disrupt the Service; attempt to access accounts or data that are not yours; scrape, copy, or resell the Service; upload harmful code; or harass other users.

Cost

Whale Limit is free to use. There is no charge to create or run a pool, no per-week or per-player fee, no player limit, and no payment method is required.

Third-party data

Spreads, scores, and schedules come from third-party sources. They may be delayed, incomplete, or incorrect. A commissioner chooses the settings that decide how results are graded, and grading decisions within a pool rest with that pool.

Intellectual property

The Service, including its software, design, and content, is owned by Whale Limit and protected by law. We grant you a limited, personal, non-transferable license to use the Service as intended. You may not copy, modify, or create derivative works from it.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that third-party data will be accurate. We are not responsible for disputes among pool members or for any money exchanged among them.

Limitation of liability

To the fullest extent permitted by law, Whale Limit will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, arising out of your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

Indemnification

You agree to indemnify and hold Whale Limit harmless from claims arising out of your use of the Service, your pools, or your violation of these Terms or any law.

Termination

You may stop using the Service at any time. We may suspend or end access if you violate these Terms or use the Service in a way that could harm others or us.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You agree that any dispute will be resolved in the state or federal courts located in California.

Changes

We may update these Terms from time to time. Continued use of the Service after a change means you accept the updated Terms.

We do not handle pool money
